These are the reasons I am no longer working for Mike Foss, the owner of Dun-Rite Insulation, LLC.
After the Pay Period 1/02/2012 - 1/08/2012 I was laid off. I was making $16.00 an hour.
I was called back to work for the Pay Period beginning 1/30/2012 - 2/05/2012.
Mike Foss informed me my job had changed. He needed someone to take care of his office
and the shop. He needed someone to take care of his books. He needed someone to take care of inventory.
I was told this was the job. The pay was $10.50 an hour. I informed Mike Foss if he would train me to do his books
and how he wanted things done in the shop and the office, I would do it. I also said I would need to be working 40
hours per week if I was making $10.50 an hour.
Mike Foss said he would help me out with this. He would pay me "under the table".
I refused. I told him this was not legal and I wanted no part of it. Mike Foss became angry. He told me he
didn't want to pay unemployment insurance or worker's compensation. I told him that wasn't my problem.
I flat out told him he had to cut me a paycheck. He then told me he didn't think he could provide 40 hours a week.
I told him if that was the case, I would file a partial unemployment claim. Mike Foss told me I could not file
a partial unemployment claim. If he couldn't get an unemployment check, I couldn't have one either.
I told Mike Foss it wasn't up to him. I had a legal right to file a claim and if I wasn't eligible, the
Department of Workforce Development would make that decision.
Despite this rocky return to Dun-Rite Insulation, LLC. I went to work.
I was never trained to do books. I was not trained to run the office. There was little or no work
to do in the shop. I asked Mike Foss when he was going to train me to do his books.
He told me his books were none of my business. I asked him about running his office. He said there wasn't
any reason for me to be running his office.
What I ended up doing was being on call 24 hours a day, 7 days a week.
He would call me on the phone and tell me to pick up his kids at school.
He would call me up and tell me to mow his lawn or wash his car.
He called me up and have me drive him where ever he wanted to go, when ever he wanted to go at all
hours of the day and night. I was even told to drive to a house he was refurbishing and check to see if there was mail in the mailbox.
Between the Pay Period 2/06/2012 - 2/12/2012 and 5/21/2012 - 5/27/2012 my total hours per week
averaged around 10 hours, or less. I told Mike Foss this was unacceptable. He told me when I returned to
Dun-Rite Insulation, LLC. I would be trained to work on his books, take care of his office, and the shop.
I never agreed to be his personal servant, working on demand 24 hours a day, 7 days a week.
Mike Foss told me if I refused to do what I was told to do, he would tell the Department of Workforce Development
I refused work and he would "kick my financial ass."
For the record, he also told me the following,
"I can have you killed. My Dad was a federal judge. I can do anything I want to."
Shortly after, I called the Department of Workforce Development and talked to a UI Benefit Specialist on the phone.
I told her everything I am stating here. I told her I was under a great deal of stress because of the things that were said.
I told her I felt Dun-Rite Insulation, LLC. was a hostile work environment. I told her I was not able to continue working for
Dun-Rite Insulation, LLC. under these conditions. She told me that was my decision but if I didn't go back, I would probably be unable to continue
claiming unemployment benefits. I told her I would close my claim. I also told the UI Benefit Specialist I had done everything
possible to do what I felt was necessary to keep employed and working to satisfy any legal requirements
of the Department of Workforce Development regarding my claim. I wasn't going to accept being threatened or abused.
* I did not file a claim with the Department of Workforce Development for the last Pay Period I worked with Dun-Rite Insulation, LLC
* I could have. I decided to wash my hands of this entire sordid affair and move forward.
I informed Mike Foss my time was no longer available to him or Dun-Rite Insulation, LLC.
I told Mike Foss I was moving on and I was closing my unemployment claim.
I found work with Remedy Intelligent Staffing and received a check from them starting with the Pay Period 9/09/2012 - 09/15/2012.
I have enclosed copies of the checks requested. I have enclosed a copy of my final check with Dun-Rite Insulation, LLC.
I have been under a great deal of stress because of Dun-Rite Insulation, LLC.
To the best of my knowledge, all the information I have given the Department of Workforce Development
has been accurate regarding my claim.
I apologize for this lengthy explanation. I feel these statements had to be made and that they be on record.
